Agreement and service description

These Terms govern use of AI Pet Portraits at www.aipetportrats.com. By using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

The Service uses third-party artificial-intelligence systems to transform a photo you provide into a new image. Results are generated automatically, can vary between requests, and may contain errors. AI Pet Portraits is independently operated and is not sponsored by, endorsed by, or affiliated with any film studio, entertainment company, artist, or other brand referenced for descriptive or educational purposes.

Eligibility and accounts

You must be legally able to enter into these Terms. If you are under the age of majority where you live, a parent or legal guardian must authorize your use. You must provide accurate account information, protect your credentials, and promptly report suspected unauthorized access.

Your source photos and instructions

You retain the rights you already hold in material you upload. You represent that you own or have permission to process each photo, prompt, trademark, name, or other material you submit. You must not upload confidential material or content that infringes copyright, trademark, privacy, publicity, or other rights.

You grant us and our processing providers a limited, non-exclusive license to host, reproduce, transmit, and transform submitted material only as needed to operate, secure, troubleshoot, and improve the requested Service, subject to the Privacy Policy and provider terms.

Generated images and permitted use

Subject to payment of applicable fees, your selected plan, these Terms, provider terms, and applicable law, you may use downloaded generated images for personal and commercial projects. This permission does not transfer ownership of the Service, underlying models, software, third-party material, or trademarks.

Because outputs are generated by AI:

• we do not guarantee that an output is unique or eligible for copyright protection in every country;
• similar outputs may be generated for other users;
• you are responsible for reviewing an output before publishing, selling, printing, or using it in advertising; and
• you must not imply endorsement or affiliation with a person, artist, studio, brand, or rights holder without authorization.

Acceptable use

You may not use the Service to:

• violate law or another person's intellectual-property, privacy, or publicity rights;
• create deceptive endorsements, impersonation, fraud, harassment, hate, sexual exploitation, or child-endangering content;
• upload malware or attempt to bypass security, credit, rate, or access controls;
• reverse engineer or disrupt the Service except where law expressly permits it;
• automate abusive requests or generate artificial advertising impressions or clicks; or
• resell access to the Service itself without written permission.

We may block content, suspend processing, preserve evidence, or terminate accounts where reasonably necessary to enforce these rules or protect users and providers.

Credits, pricing, and payments

Prices, included credits, expiration periods, and plan-specific features are shown at checkout. Credits represent processing capacity, are not currency, and have no cash value. A generation may consume credits even when the subjective artistic result does not meet your preference, because provider processing costs have been incurred.

Payment providers process payment credentials under their own terms. Except where the checkout page states otherwise or applicable law requires a refund, completed digital-service purchases are non-refundable. Contact support promptly about duplicate charges, technical non-delivery, or unauthorized transactions.

Availability and changes

AI providers can experience queues, outages, model changes, and content filters. We may modify, suspend, or discontinue features and may update prices prospectively. We do not promise uninterrupted availability, a specific generation time, or a particular output.

Privacy and advertising

Our Privacy Policy explains photo processing, providers, cookies, analytics, advertising, retention, and user choices. Advertising, when enabled, is intended only for eligible public content pages and must not be manipulated or clicked by the publisher to create artificial activity.

Disclaimers and liability

To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Nothing in these Terms excludes warranties or liability that cannot legally be excluded.

To the extent permitted by law, AI Pet Portraits and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunity. Any aggregate liability will not exceed the amount you paid to the Service during the six months before the event giving rise to the claim. These limits do not apply where prohibited by law.

Termination and disputes

You may stop using the Service at any time. We may suspend or terminate access for material breach, fraud, abuse, security risk, nonpayment, or legal requirements. Provisions concerning intellectual property, disclaimers, liability, and disputes survive termination.

These Terms are governed by the laws applicable to the Service operator, without overriding mandatory consumer protections that apply where you live. Before filing a formal claim, contact us so the parties can attempt to resolve the issue informally.

Changes and contact

We may update these Terms prospectively. Material changes will be posted with a new effective date. Continued use after the effective date constitutes acceptance where permitted by law.
